Terms and Conditions

This section holds important information about the terms and conditions of a Creation Box pencil portrait commission. Please ensure you read and understand them before placing an order for a portrait. If you proceed to commission a portrait from Creation Box you are agreeing to the following terms and conditions at the point of placing an order.

  1. Approval of Image(s)

A commission may not be accepted until Creation Box confirms your source image(s) are suitable to be used as the basis for a portrait to be drawn or produced for a digital print. Creation Box reserve the right to refuse a commission if believed the source image(s) are not to the standard required to create a portrait or digital print of acceptable quality. Please note, if images are of a lesser quality than desired and you wish to go ahead, you do so at your own risk although Creation Box will aim to produce the best.

  1. Payment Terms

The total commission price including postage and packaging is required upon ordering to confirm your order and secure a place in the order log. Work will not commence on your artwork until your payment has been received. All commissions must be paid for in full unless stated otherwise before the artwork is completed and/or delivered to you. Payment of the postage and packaging/delivery/mileage charges are due when you place your order.

  1. Payment/Refund Currency

Prices are quoted and invoiced in UK pounds for all clients, whether UK based or international. Any refunds will also be made in UK pounds and Creation Box cannot be held responsible for any loss due to exchange rate fluctuations between the time of your payments to Creation Box and the issuing of the refund.

  1. Completion Timescales

The completion of all commissions is managed through an order log which works on a first come first served basis. The estimated time for your commission to be completed is measured from when you make your payment. The time it will take to complete your artwork will depend on the number of commissions that are already confirmed in the order log at the time you place your order and also the complexity of your commission requirements. Whilst every effort will be made to meet the estimated completion date, Creation Box cannot be held responsible for any delays to completion timescales due to reasons that are beyond control.

  1. Cancellation of Commission Prior to Completion of Portrait

If you wish to cancel your commission, please notify Creation Box as soon as possible. All commissions can be cancelled by email to [email protected]

5.1 Cancellation within two days of placing an order for a Portrait Commission

If you decide to cancel your commission within 48 hours of placing your order you will be entitled to a full refund of the amount you paid to Creation Box.

5.2 Cancellation after two days of placing an order for a Portrait Commission

If you decide to cancel your commission after 48 days of placing your order you will not be entitled to a refund of the amount paid to Creation Box as work would have commenced accumulating labour.

5.3 Refunds

Refunds will be made via PayPal or the original payment method used by the client. Refunds cannot be made to another person, card, or account.

  1. Delivery

UK orders are sent using Royal Mail First Class Signed. The delivery will need to be signed for when it arrives. You can choose an alternative address if required, therefore you must ensure to clearly state this during the order process.

For overseas orders, the postal service used will be Royal Mail International Tracked and Signed. The delivery will need to be signed for when it arrives. You can also choose an alternative address if required, therefore you must ensure to clearly state this during the order process.

Alternatively, other options may be considered based on the size of artwork or project.

  1. Import Duty

Delivery outside the UK may be subject to local import taxes which are the client’s responsibility.

  1. Delivered Artwork, Projects and/or Services

All pencil portraits will be delivered in a postal tube or hardboard packed envelope. Frames are not provided.

All digital prints will be digitally sent to the email address provided. Other artwork, projects and services may be subject to negotiation of alternative methods.

  1. Damage in Transit

Your artwork will be packed to a high standard. If in the unlikely event your artwork is damaged it will need to be returned in its original packaging at your own cost. If it is approved that it was not your own mishandling, it may be redrawn/recreated for you free of charge. There will be a wait time for the completion of the replacement artwork as it will need to be investigated and rescheduled in the order log.

  1. Source Images

When you send image(s) to use as the source material for your commission you are confirming that you either own the copyright to the image(s), or have gained permission and/or a license from the copyright owner to grant Creation Box a license to use the image(s) as the basis for producing your artwork. Also, granting to display on the website gallery pages, or in promotional material for an indefinite period of time. If you do not want your source image(s) to be used in this way, please contact Creation Box when you place your order. In addition, in sending the image(s), you agree to indemnify Creation Box against any costs arising from claims subsequently made against Creation Box by any persons claiming to own the copyright to the image(s).

  1. Money Back Guarantee

Creation Box will ensure to meet, or better still, exceed your expectations with the finished artwork; all portraits, digital prints, projects and services are guaranteed to be a likeness. If you are not entirely satisfied with the finished work you will be under no obligation to buy providing you have exhausted all options. Your options are as follows:

 11.1. Request Alterations to the Portrait

You have a period of 48 hours from the date of approval request to contact Creation Box if you wish to request changes to be made to a pencil portrait. Please note, if no request for changes are made Creation Box will assume approval and process the delivery. If a request for change(s) are made Creation Box will follow up your request. Once the alterations have been made, you will be sent a new scan of the artwork for your approval. This process may be repeated no more than three times if seen fit.

Please note that repetitive alterations can deteriorate the texture and effect of the pencil portrait. Please note that this may potentially exceed the expected completion date. If after the changes have been made, you remain unhappy with the pencil portrait you will be under no obligation to buy it providing you can evidently identify significant valid reasons.

 11.2. Return the Portrait after Approval

If you are not completely satisfied with the portrait and wish to return it to Creation Box for a refund, you must send the portrait safely packaged and undamaged within five days of receiving it. You will then, if approved be refunded 30% of the price paid for the pencil portrait commission. Creation Box will retain the artwork and copyright and the right to display or use the image for promoting a sale. Please note, the client must meet the costs of shipping the portrait back to Creation Box. Portraits returned damaged and/or after five days of delivery will not be refunded.

  1. Artwork Framing

After you have received the artwork, Creation Box is not responsible for how the artwork is framed or displayed, whether by a third party, or the client, or any resultant damage to the portrait.

  1. Care of the Artwork after Delivery

Once framed, it is recommended you hang or display your artwork in an area that is not subject to high humidity, such as bathrooms, or significant temperature changes, directly above radiators, or in direct sunlight, as this may affect the paper over time. Creation Box is not responsible for any damage or deterioration that occurs to the artwork once delivered.

  1. Copyright – Images and Content found on this Website

All images and content found on Creation Box website are subject to copyright and are the sole property of Creation Box unless otherwise stated. Images and content may not be reproduced or distributed without express written permission from Creation Box. If you wish to use any of Creation Box artwork for a publication, or website please contact [email protected] and if authorised to use images by third party organisations Creation Box must be credited for the work. Creation Box will request the removal of any images found on unauthorised websites.

  1. Copyright – Produced Artwork

Creation Box retains copyright on all the artwork produced. By submitting an order electronically, you are agreeing that Creation Box retains the full copyright and licensing rights to the artwork produced from your image(s), thereby allowing to use the artwork in any way seen fit for an indefinite period of time. This includes displaying the artwork in promotional materials and online. Commissioned artwork is normally displayed on the Creation Box gallery pages when completed, but may also be submitted to other online hosted galleries. The artwork created are only ever used by Creation Box as promotional material – Creation Box does not create copies to sell on as merchandise, or as prints. Under no circumstances should artwork by Creation Box be made available for additional sale, or permission given for third parties to use the artwork without express written permission. Creation Box reserves the right to take legal action against any individual or business failing to adhere to the above Copyright Terms and Conditions.

  1. Changes to the Terms and Conditions

Creation Box reserves the right to change the Terms and Conditions and publishing a new version on the website. The new version will take effect from the time of publishing on the site.

  1. Applicable Laws

All commission orders from Creation Box are subject to the laws of England and the courts of England shall have exclusive jurisdiction in relation to any disputes.
